DESCRIPTION:In California\, placing real estate into a properly drafted trust is one of the most effective ways to keep property out of probate. When a home or other real property is owned by a trust rather than an individual\, it can transfer directly to the next owner after death without court involvement\, delays\, or public filings. This approach matters because probate in California is often slow and costly\, particularly when real estate is involved\, and a trust allows property to pass in a more controlled and private way to the beneficiaries you choose. \nHow Probate Works for Real Estate in California\nIf you own real estate in your individual name when you pass away\, that property usually must go through probate. The court oversees the transfer\, even when there is a valid will. \nProbate can involve: \n\nCourt filings that become public record\nStatutory fees based on the value of the property\nDelays that often last a year or more\nLimited flexibility if issues arise between heirs\n\nFor example\, if you own a California home titled solely in your name\, your family may be required to open a probate case just to transfer ownership\, even if there is no disagreement. \nHow a Trust Keeps Real Estate Out of Probate\nA trust works by changing how property is owned. Instead of holding title in your individual name\, the property is transferred into the trust during your lifetime. You still control and use the property\, but legally\, the trust becomes the owner. \nWhen you pass away\, the successor trustee you named can transfer the property according to the trust terms\, without court approval. \nThis process allows: \n\nFaster transfers to beneficiaries\nPrivacy\, since trusts are not public records\nFewer administrative steps for loved ones\n\nA common scenario we see is a homeowner who places their primary residence into a revocable living trust. After death\, the successor trustee records a few documents\, and the property moves to the intended beneficiary without probate. \nCommon Real Estate Scenarios Where Trusts Help\nTrust planning is especially helpful in situations like these: \n\nYou own a home and want it to pass directly to children or a spouse\nYou own rental property in California\nYou want to avoid court involvement if you become incapacitated\nYou own property with a partner who is not your spouse\n\nFor instance\, unmarried partners often assume joint ownership will solve everything. In reality\, if the property is held as tenants in common or is otherwise not structured with survivorship rights\, probate may still be required for one partner’s share. A trust can prevent that outcome. \nWhat Happens If Real Estate Is Not Properly Transferred to the Trust\nCreating a trust alone is not enough. The real estate must be formally transferred into the trust through a recorded deed. \nIf this step is missed\, the property may still be subject to probate. This is one of the most common issues we encounter when reviewing existing estate plans. \nWe help clients avoid this problem by confirming that deeds are prepared\, recorded\, and aligned with the trust terms\, so the plan works as intended. \nTrusts vs. Other Probate Avoidance Options for Real Estate\nSome people consider alternatives such as transfer-on-death deeds or joint tenancy.
